Enactment, Amendment and Abolition of Ordinances

Provincial councils exercise the legislative power of local autonomy to enact and amend ordinances, the autonomous administrative power to deliberate and settle budget bills and monitor administrative activities of the executive body by carrying out audits and inspections. Also, the councils process petitions submitted by the citizens as well as other matters under their jurisdiction in pursuant to the laws and ordinances.

Enactment, Amendment and Abolition of Ordinances

Ordinances are laws enacted by local governments through the decision of the local councils. Ordinances of Chungcheongnam-do are laws of Chungcheongnam-do. Matters including penalties related to limitations to the rights of the citizens or imposition of duties may only be brought into force or altered by statutory instruments and local governments may set fines up to KRW 10 million for violations of ordinances.

Procedures for Enacting an Ordinance

  • Bill Proposal
    • Signatures of at least one-fifth of incumbent council members or by a committee, the governor or superintendent of schools
  • Voting
    • By a majority vote of the incumbent council members
  • Transfer
    • Transferred to the governor (superintendent of schools) within 5 days after decided by the Council
  • Promulgation
    • By the governor (superintendent of schools) within 20 days (The ordinance comes into effect 20 days after it’s promulgated unless otherwise specified) )

If the governor (superintendent of schools) request reconsideration to the Council on their bill, the Council submits the bill for reconsideration and when the bill earns a two-thirds vote of the majority of the members present, it becomes an ordinance.
